Terms and Conditions
SAP x FCB Competition

These terms and conditions and privacy information (hereinafter collectively referred to as "Terms and Conditions") apply to participation in our "SAP x FCB-Quiz" ("Contest"). The Terms and Conditions contain rules, including participation guidelines, information about prizes, and the processing of participants' data, as well as information about their rights of objection and revocation.

1.    Organizer
The organizer of the contest is: 
SAP SE, Dietmar-Hopp-Allee 16, 69190 Walldorf (hereinafter referred to as "SAP SE" or "Organizer"). By participating in this contest, you (hereinafter "the participant") accept these terms and conditions.
Information about the cooperating association:
We organize the contest as a sponsor and organizer in cooperation with FC Bayern München AG (hereinafter also referred to as "Association"). The Association collaborates in the execution of the contest but is not the organizer.

2.    Restriction of Participants
Eligible to participate are generally all natural persons who have reached the age of 18 and complete the quiz via social media. Each person can only participate in the contest once. Excluded from participation are only people who were involved in the creation of the contest.

3.    Participation, Participation Period, Determination of winner (s), Prize 
a)    Participation: To participate, the question on the FC Bayern Women's Instagram post, presented by SAP, on February 15th-16th must be guessed correctly. Participation does not require the purchase of goods or services. Participation in the contest, answering by direct comment, is free. No paid services need to be used for participation.
b)    Participation Period: The contest starts on February 15th, 2023, with the live launch of the competition and ends on February 16th, 2025.
c)    Determination of winner: Among all participants who have guessed the correct result, four will be randomly selected by raffle and allocated the prizes.
d)    Prize:
Participants who answer correctly and are randomly chosen will receive one prize each:
-    1x signed Magdalena Eriksson jersey
-    1x signed Klara Bühl jersey
-    2x signed match balls 

4.    Winner Notification and Prize Claim
The winners will be notified via private direct message from FC Bayern Women Instagram (Private Message) after the end of the contest and must then also respond via direct message to FC Bayern. Participants are responsible for the accuracy of the contact information required to receive private direct messages on social media. If winners cannot be notified due to incomplete or incorrect contact information, the claim for the prize is forfeited. If the winner does not respond within 2 days after notification, the claim to the prize expires, and an alternative winner will be determined. The prize claim is not transferable. Cash payment or exchange of prizes is not possible. Personal information must be truthful. Any additional costs associated with claiming the prize are the responsibility of the winning participant. The participant who has won is responsible for any tax on the prize.
There is no entitlement to participate. We are entitled to disqualify participants and exclude them from the drawing who manipulate the participation process, the system, and/or the drawing/pages or attempt to do so and/or violate the terms and conditions or good manners and/or attempt to influence the drawing in an unfair or unethical manner.
We reserve the right to cancel or terminate the contest at any time without prior notice and without stating reasons. We are particularly entitled to do so if the proper execution of the contest cannot be guaranteed for technical or legal reasons, for example.

5.    Data Protection
Personal data will not be sold or rented. For the execution of the contests, SAP may transfer necessary services in whole or in part to external service providers or partner companies of SAP SE, as well as to companies affiliated with SAP SE (collectively "authorized third parties"). The participant agrees that SAP SE collects and/or processes the data for the stated purpose either itself or through authorized third parties and transmits the data to authorized third parties.
Furthermore, SAP SE only transfers personal data to third parties if required by law, especially if necessary for legal prosecution to prevent abusive participation in contests in violation of the terms and conditions. Participation can be revoked at any time. Please address your revocation to: info@sap.com. Upon receipt of the revocation, personal data will be deleted immediately.

6.    Statements regarding this contest: 
1.    This contest is not associated with Facebook and Instagram. It is in no way sponsored, supported, or organized by Facebook or Instagram.
2.    Facebook and Instagram are exempt from any claims for damages that could arise during the implementation of this promotional campaign.
3.    Questions, comments, or complaints about this contest should not be directed to Facebook or Instagram.

7.    Disclaimer
All participants participate in the contest at their own risk, to the extent permitted by law. The organizer (together with all other partners associated with this contest) assumes no liability for the contest and the prizes in any way. The organizer is not liable for the behavior of participants or the behavior of winners or for circumstances beyond the control of the organizer regarding the contest and the prizes.

8.    Applicable Law
The contest of the organizer is subject exclusively to the law of the Federal Republic of Germany. Legal recourse is excluded.

9.    Severability Clause

Should a provision of these terms and conditions be or become wholly or partially invalid, the validity of these terms and conditions in all other respects shall not be affected. Instead of the invalid provision, the legally permissible regulation that economically comes closest to the purpose expressed in the invalid provision shall apply. The same applies in the event of a regulatory gap in these terms and conditions.
